Traffic Ticket Attorney

Traffic ticket attorneys and those fighting traffic tickets they received due to reflex’s red-light cameras have chalked up several court victories in the past few months. Many agencies and cities, including some in the Bay Area as well as Southern California, have abandoned the enforcement tool in wake of bad press and unmanageable relationships with the camera company Redflex.

While traffic ticket attorneys have been slowly shutting down red light camera tickets, the California legislature is attempting to draft legislation making it tougher for traffic ticket attorneys and citizens alike to challenge their citations. In fact, the legislation could ultimately end one’s right to a bench trial for red light camera infractions.

The legislation, being termed the devils bill, being proposed is California Assembly Bill 666. This bill was authored attorney and Assemblyman Bob Wieckowski, a democrat from Fremont California in Alameda County. At first glance, the legislation appears to be as “non-substantive” as it claims to be, dealing with the required signage and positioning of “automated traffic enforcement” warnings and changing the word “jurisdiction” to “authority” in the California code.

California Assembly Bill 666, would deny crucial due-process rights to motorists who receive red-light camera tickets. Essentially setting up administrative hearings ran by the department who issued the citation. The bill would make the owner responsible for red light tickets regardless of who was driving the vehicle.

While the assembly man is attempting to paint the bill as something which will not infringe on any rights, this is far from the truth. A group, known as “Stop AB666” has pointed out that the bill is bad for the following reasons:

• AB 666 Would Strip You of Your Right to Face Your Accuser (Confront and Cross Examine Accusers Against You)

• AB 666 Assumes That You Are Guilty and You Would Have to Prove Your Innocence at Their Hearing

• AB 666 Would Require You to Pay a Fee If You Want Your Case Heard in Court

• AB 666 Would Expand the Use of Photo Enforcement to Other Traffic Violations

• AB 666 is Bad Public Policy

Assemblymember Wieckowski’s office has been swamped with calls from California motorists who oppose AB 666, yet the bill continues its march through the Assembly. AB 666 represents a cynical attempt to further prey on responsible drivers.

“REDWOOD CITY, Calif. (KGO) — A red light camera vendor that services many Bay Area cities is being investigated in Chicago for corrupt business practices.

Last week, Chicago Mayor Rahm Emanuel dumped the city’s longtime red light camera vendor, Redflex Traffic Systems.

News reports disclosed a deepening corruption scandal involving Redflex and a former city official.

A company-sponsored investigation found that two of its executives had given lavish gifts to the official and that it was covered up when reporters began raising questions.

Redflex also has lucrative contracts with many cities in the Bay Area and the rest of the state.

“What it indicates for me is just the entire history of the red light camera problem in California and elsewhere,” said State Senator Jerry Hill (D-San Mateo).

He’s been a vocal critic of red light cameras and has sponsored several bills to weed out abuses in the system.

“They created a deal where it was incentivized so that the more tickets they wrote, the more money they made,” he said.

Hill says there’s a lot of money to be made by the makers of red light cameras. “When there’s a lot of money attached to it, you also start seeing some bad actors, and I think Redflex got caught.”

Attorney Mendelson has represented many red light camera violators. “The red light cameras, I think they’re $6,000 per intersection per month. So you’ve got a contract that’s worth a fortune,” she said.

Both Mendelson and Hill told ABC7 News that in light of the Chicago scandal, cities in the Bay Area ought to initiate audits and review contracts with Redflex and other traffic camera makers.

“Certainly I think cities and counties and towns ought to look into whether Redflex paid anybody any money or any consideration of any kind to get their cameras put up,” Mendelson said.

Redflex’s CEO said in a statement: “We learned that some Redflex employees did not meet our own code of conduct and the standards that the people of Chicago deserve. We are sharing information with law enforcement authorities and will take corrective action.”

There have been serious ripple effects from the scandal. The chairman of the Redflex’s Australia-based parent company resigned and the Australian stock market suspended trading on the company’s shares.

Motorcycle Ticket Attorney Explains Lanesplitting

In every state, except California, a motorcyclist maneuver known as lanesplitting is not legal. Further, the guidelines for this maneuver have been posted for the first time on the California Highway Patrol’s (CHP) website.

Motorcyclists should review the guidelines as safety tips for sharing the road, according to Seargent Mark Pope, California’s statewide coordinator for CHP’s California Motorcyclists Safety Program. He went on to state that “the purpose (of posting the guidelines) is to improve public safety by promoting public awareness,” Pope stated to the press.

The need to increase attention and awareness comes just after a survey was administered by the California Office of Traffic Safety. The survey found that Thirty-seven percent of 733 drivers surveyed were unaware lane splitting was even legal anywhere, let alone in California. Seven percent had even admitted that they even made attempts on an occasion to prevent a motorcycle from maneuvering past their vehicle.

The “educational push,” as Sgt. Pope called it, is also an emotional response to preliminary numbers that show a 20 percent increase in motorcycle deaths from 2011 to 2012, he explained to the press.

One tip on the guidelines is for “competent enough” motorcycle operators should not travel faster than 10 miles per hour more than traffic. This was occurring at a reported 33.8 percent of those surveyed.

Most motorcycle riders, after reviewing the guidelines, agree that the guidelines are reasonable and in fact the go above every other state in the country. More specifically, Dave Finnerty, general manager of Victorville Harley, reviewed the guidelines and found what he read reasonable. “I think the biggest thing now is there’s an actual guideline. It’s not subjective,” he said. “They’re common sense (tips).” Finnerty said he believes riding between lanes is safer for motorcyclists such as himself, where riders can be more in control of their own safety. A major concern of many motorcycle riders is being rear-ended. “As motorcyclists, we’re a little more vulnerable,” he said. “Raising awareness is important.”

Opponents of the guideline point to the lack of safety while doing these maneuvers. Nathan Robinson, general manager at Barstow Motorcycle Center, believes that lane splitting is an unsafe manuever. “We’ve had customers who’ve had car doors opened on them,” he said. Even within pronounced safety guidelines, he said, “people will push the envelope.”

Law enforcement is on the side of Finnerty and they hope that Robinson is wrong. For many years, the CHP website has noted lane splitting was legal when done in a safe and prudent manner by experienced motorcycle riders, but the problem was “no effort had been made before to define safe and prudent,” Pope said.

The guidelines, developed with traffic safety stakeholders, motorcycle safety experts and other law enforcement, can also be found on the CA OTS website. In May of this year, Motorcycle Safety Awareness Month will bring an effort to reinforce these CHP guidelines, as explained by Pope.

Our hearts go out to the victims of the Connecticut School shooting. I will not mention the shooters name and I strongly feel that the media should take the same approach. The mentioning of a name only entices others to copy the incident because of the exposure that is gained after the incident. More specifically, while we may never know the motive of a “bat-s&*t” crazy shooter, it is proven that some are tempted by the media exposure. Many shooters have delusions of grandeur and are enticed by having their name written in text books for years to come. Many mass shooters are not mentally together and this incident should be a stern wake-up call to the United States. Namely, mental health is important and we should ensure that mental health is a priority the same way that physical health is important. We need to eliminate the obscenely strong stigma attached to seeking mental health attention. However, now is not the time to say what went wrong; Now is the time to come together as a community. There are no words that can be spoken to make anything better. All we can do is offer our sincere condolences and leave the families alone. The constant media attention is a cancer to the families who only want to grieve in private. If you want to show your support, donate to the families and fly the flag at half mast.

Duck Thief Returns Duck

I used to live less than a mile from Fairyland in Oakland and I enjoyed seeing the sign with the duck and goose. A few months ago, the duck went missing. However, Children’s Fairyland executive director C.J. Hirschfield, released some good news about the stolen duckling sculpture. Apparently the duck thief had a heartfelt moment and placed the stolen duck off in the early morning at the gate entrance to the park.

Children’s Fairyland is a small theme park in Oakland on Lake Merritt. This park is not making huge profits and in fact, they struggle to make sure that all their bills are paid. They recently built their most ambitious project in many years: the Aesop’s Playhouse theater. After the theater was built, a duck thief broke into the park after closing and stole the duckling sculpture from its perch above the new theater.

Supporters of Oakland’s Fairyland were extremely upset and they pledged to raise the money for the statute. However, the amount that they were looking to raise was $7500!! This amount of money was not easy for a penny pinching small amusement park during the worst economic times of the century.

No matter what the reason for returning the duck was, I am glad he is back home. It is common that a criminal will not look into the consequences for his actions and instead will act on impulse. I do not know who the duck thief was in this instance and would not like to jump to conclusions. However, I hope he or she learned a lesson and does not continue this type of behavior. This story is on my website because we love happy endings and this ending should bring a smile to your face. Next time you are in Oakland, go say hi to the duck at Fairyland on Lake Merritt.

Even the Archbishop is in DUI Trouble… California DUI Defense

I practice California DUI defense and every week I have clients in my office explaining their DUI story. Most of them tell me that they never thought they would get caught for driving under the influence. Most clients have a huge shock when they are arrested and are facing criminal charges and always tell say “how could this happen to me?? I am not a criminal!” The truth is: if you drink and drive, sooner or later you will get caught. Some people can get away with it for years and some people only need to drive one time drunk. DUI arrests do not discriminate: young, old, rich, poor, white, African-American, religious, atheist… If you drive while under the influence, you are gambling- Nobody is above the law. In fact, I have seem CHP officers arrest their own mother.

Recently, the bishop who is due to take the reins of the Roman Catholic Archdiocese of San Francisco was arrested for a DUI in San Diego. He was arrested after leaving a dinner in San Diego by the SD Police Department.

56 year old Bishop Salvatore Cordileone was driving along the border of San Diego State University (SDSU) when he encountered a routine field sobriety checkpoint. Cordileone appeared to be intoxicated and he was placed under arrest at 12:26 a.m. on Saturday 8-25-12.

The day after being arrested, bishop Cordileone was released from the County jail. He was released before noon the next day when he posted $2,500 bail. He is scheduled to be appear in court to be arraigned on misdemeanor charges (CVC 23152(a) and CVC 23152(b)) on October 9, 2012.

When asked about the incident, Officer Hassen stated: “He’s probably our highest profile DUI arrest in awhile.”

Cordileone has been the bishop in Oakland, CA since 2009 and was just named in July by the Vatican to become the new archbishop in San Francisco, Ca. He has roots in San Diego, CA. He was born there, studied at the St. Francis Seminary in SD, and served as an official for many years in its diocese. He was appointed auxiliary bishop of San Diego in 2002, was ordained a bishop later that year, and then was appointed bishop of Oakland on March 23, 2009 by Pope Benedict XVI.

The archbishop’s California driving record is clean except for one ticket he received on December 23 for failure to make a complete stop at a stop sign, according to the California Department of Motor Vehicles (CA DMV).

I hope that the arrest of Mr. Cordileone can be a lesson to everyone. Nobody is above the law with DUI’s. Even the bishop can be arrested for a DUI.

The small town north of the Bay Area called Shingletown has been in fire trouble every 5 years or so. However, this year the fire is worse than most can remember. Since fires happen in this area every few years, most residents have insurance that covers wildfires. This means that most homes and land that are destroyed will be covered by insurance. This year, the fires were started by lightning strking near the home of Lynn Rodgers. The resident stated, on Tuesday, that she was optimistic about the outcome. Ms. Rodgers stated “what can you do? Everything is in God’s hands — and the firefighters.”

Firefighters seemed to be making progress toward the fire when the wind shifted. However, the fire has already destroyed 7 homes and many residents have left the area to take shelter at a Redding sports complex. In fact, since Saturday, the fire grew to over 30 square miles. Around 1,900 firefighters were attacking the fire as it threatened 3,500 homes in the towns of Shingletown, Manton and Viola.

California almost always has fires this time of year and this year there are many burning already. In fact, Gov. Jerry Brown announced Tuesday that National Guard troops will be assisting firefighters. The news from Sacramento came a day after the Federal Emergency Management Agency (FEMA) said it is offering federal funds to help fight the blaze.

DMV Computers Crash; DMV Employees Freak Out.

DMV Computers Crash… DMV Fail

The DMV had some unexpected errors in their computer system earlier today. The computer network at the California Department of Motor Vehicles (DMV) crashed for several hours today (8-14-12). The crash caused the clerks to do the same job that DMV clerks had 20 years ago before computers. This change in their routine grumbling 9-5 day made many clerks upset and angry that they have to complete their work using their hands and a pen. I am sure we all feel sorry that the DMV employees were forced to the slave job that existed before computers.

A DMV spokeswoman, Jessica Gonzalez, reported that the problem was resolved around the noon lunch hour on Tuesday and their poor state workers were catching up on the backlog created by the computer problem. She went on to state that the local offices are now anticipating a busy next few days due to rescheduled appointments. The spokeswoman did not reassure anybody that the catch up would be done in a smart and efficient manner. In fact, they anticipate that the wait will be even worse than it already is.

Jessica Gonzalez instead is trying to send people away from dealing with actual people and urged the public to use the DMV’s website as an alternative. The DMV administers nearly 24 million driver’s licenses and 31+ million vehicle registrations every year yet they still get that wrong in many instances. One would assume that with millions of customers, they would get it down right. Instead they will treat you with an attitude and send you on your way without answering your questions- isn’t it easier if they just send you to someone else?

The state technology agency was responsible for the computer errors and I am sure there were many expletives directed at them from grumbling DMV employees today. A spokesman for the tech agency, Adam Dondro, analogized the problem to when a home or office experiences Internet connection problems and routers must be reset. The spokesman stated that state workers needed to identify the failed router, which disconnected DMV’s computers from the network.

“We haven’t been able to isolate it,” Adam Dondro said when the connection issue was still being investigated. “It’s somewhere between one of the routers and either our technology router or a Verizon router. We’ve been kind of peeling the onion to try to figure out where it is and haven’t been able to nail it down yet.” Later it was determined that the problem came from a state router.

Slightly after noon today, Mr. Dondro stated that “All systems in the state are back up and running, including DMV.”
